NOTICE OF PROPOSED ZONING AMENDMENT,
NOTICE OF INTENTION TO CLOSE A PORTION OF LANE,
AND NOTICE OF DISPOSITION OF CITY LANDS
The City of Kimberley will be considering first reading of the following proposed zoning bylaw amendment at the regular meeting of Council on Monday, June 22, 2026 at 7:00pm:
Bylaw No. 2808, City of Kimberley Zoning Bylaw No. 1850, Amendment No. 183, 2026
The proposed bylaw involves an approximate 3m x 36.6m portion of the Black Bear Crescent road dedication, shown in hatch-pattern and dashed outline on the map below, immediately adjacent to the property at 10 Jim Ogilive Way.
If approved, proposed bylaw 2808 would change the zoning of the subject land from Residential Standard (RS) zone to Multiple Unit Residential (RM) zone matching the RM zoning of the adjacent property at 10 Jim Ogilvie Way. The proposed rezoning will support the continued use of the subject land as part of the on-site parking area for the Harvest Apartments.
The City of Kimberley also gives notice, pursuant to Section 40 and 94 of the Community Charter, of its intention to adopt Highway Closure and Dedication Removal Bylaw No. 2807, 2026 to permanently close to traffic an approximate 3m x 36.6m portion of the Black Bear Crescent road dedication, shown in hatch-pattern and dashed outline on the map above, and shown as “ROAD TO BE CLOSED” on reference plan EPP152234 prepared by Wade A. Roulette, BC Land Surveyor.
The City of Kimberley further gives notice, pursuant to Sections 26(3) and 94 of the Community Charter, of the sale of the closed portion of road described above, subject to approval of Bylaws 2807 and 2808, to 102156928 Saskatchewan Ltd. for the purchase price of $13,566.77 plus survey, rezoning and land transfer expenses. The closed portion of road will be consolidated with the adjacent property, owned by the purchaser, at 10 Jim Ogilvie Way.

The City of Kimberley will be considering first reading of the following proposed zoning bylaw amendment at the regular meeting of Council on Monday, June 22, 2026 at 7:00pm:

The proposed bylaw involves an approximate 430.1m² (4,630ft²) portion of the City-owned parcel legally described as part of Lot B District Lots 13799 and 13801 Kootenay District Plan NEP23533 Except Plans EPP20891 and EPP55478 (PID: 023-612-339). This property is located between Gerry Sorensen Way, Dogwood Drive and immediately adjacent to the residential property at 933 Dogwood Drive as depicted in hatch-pattern and dashed outline in the map provided below.
If approved, the proposed bylaw would change the zoning of the subject land from Multiple Unit Residential Tourist Accommodation (RMTA-1) zone to Residential Standard (RS) zone to match the RS zoning of the adjacent property at 933 Dogwood Drive.
The City of Kimberley further gives notice pursuant to Sections 26(3) and 94 of the Community Charter of the sale of the subject land described above, subject to approval of Bylaw 2810, to Darryl Price for a purchase price of $86,020 plus survey, rezoning and land transfer expenses. If the proposed zoning amendment receives final approval from Council, the subject portion of the City-owned parcel will be sold and consolidated with the adjacent property at 933 Dogwood Drive, owned by the purchaser.

This bylaw proposes to rezone the subject property located at 660 Knighton Road, legally described as Lot B District Lots 1879, 6578, and 6626 Kootenay District Plan 12868 (PID: 005-222-087) from Multiple Unit Residential Zone (RM) to Residential Standard Zone (RS). This proposed rezoning is intended to support the continuation of the single unit dwelling use, which is not a permitted principal use under RM Multiple Unit Residential zoning.

The City of Kimberley will be considering first reading of the following proposed zoning bylaw amendment at the regular meeting of Council on Monday, June 22, 2026 at 7:00pm:

This bylaw proposes to rezone the property located at 505 4th Avenue, legally described as Lot 1 District Lot 2999 Kootenay District Plan NEP4043 except Plan 8929 (PID: 015-067-131) from Residential Standard Zone (RS) to a new zone titled Multiple Unit Mixed-Use Residential (RMMU). This rezoning is proposed to accommodate a multiple unit mixed-use development on the subject property.
The proposed RMMU zoning designation would accommodate multiple unit residential as the primary land use with provision for limited accessory commercial uses on the ground floor of a multi-unit residential building.
The proposed RMMU zoning regulations are similar to those set out in other RM Multiple Unit Residential zones but with provisions for additional height and allowance for limited ground floor commercial uses. The allowable mix of permissible accessory commercial uses, including convenience store, art and craft studio, health and wellness practitioner, restaurant, or retail, is consistent with other mixed-use zones and the accessory community commercial use recently established for other residential zones. Like other RM zones, the proposed RMMU zone sets a maximum building height of 12m for most buildings but increases the potential bonus height provision to allow up to 18m in height for principal buildings where a housing agreement is established designating at least 20% of units as affordable housing. The proposed RMMU zone maintains the step back requirements in accordance with other tall building zones to help mitigate impacts to neighbouring properties and ensure that building massing maintains a pedestrian-friendly scale.
